Because of the Minsk agreements the situation remains “neither peace nor war” – the head of the Civil Organization “Center for Strategic Studies”

“Minsk agreements are not a treaty, but a rigged game,” said Viktor Shyshkin, a former judge of the Constitutional Court of Ukraine (2006-2015) during a briefing at the Ukrainian Crisis Media Center. The public organization “Institute of Law and Society” analyzed deeply the Minsk agreements and presented its own conclusion. There are 28 commitments in the agreements, 22 are assigned to Ukraine, 6 to the OSCE. “Two obligations are imposed on those whom we call separatists, but for me they are collaborationists. One more commitment is for Russia, “said Mr. Shyshkin.

By the way, it is not clear at all that Russia is a party to the conflict. It is represented everywhere as an observer and peacekeeper. Paragraph 10 states that it is necessary to withdraw foreign troops, without specifying which one. Item 11 provides for the adoption of a new Constitution of Ukraine. In accordance with the current Basic Law, the constitutional system can be changed only by the Ukrainian people. The judge of the Constitutional Court (2005-2015) drew attention to the fact that President Kuchma was only entitled to participate in the negotiations, the right to sign any documents on behalf of Ukraine was not granted.

The Minsk agreements connect the government with the continuation of sanctions. They were accepted by the world community right after the annexation of the Crimea, which is not mentioned in the agreements at all. “The attitude to legally void documents should be unequivocal. We have to consider fundamentally these documents as insignificant and prove to the western partners that there are other mechanisms of influence on the aggressor, ” said Ihor Todorov, Professor of the Department of International Studies and Public Communications of the Uzhhorod National University, during Skype-inclusion.

One settlement format is the one provided by the Budapest Memorandum with the participation of the United States, Russia, the UK, Ukraine, France, and China. “Another option is to declare this territory temporarily occupied by the Russian Federation. The adoption of such an option does not say that we are abandoning these territories. In contrast, this format assumes that Ukraine will never reject these territories, that the citizens, who are living there, are citizens of Ukraine “, – said Pavlo Zhovnirenko, chairman of the Board of the Center for Strategic Studies.

At the end of the briefing, the head of the NGO “Ukrainian National Council of Donetsk and Luhansk regions” Stanislav Fedorchuk submitted a statement from the organization. “We call things their real names and believe that everything that happened after February 20, 2014 is the war against Ukraine, and Russia is an aggressor … and a sponsor of the occupation of the Crimea and parts of the Donbas.” Also, Mr. Fedorchuk presented a plan to resolve the crisis in the East of Ukraine. Among the main points of the plan are the renewal of Budapest format, the declaration of a moratorium on any changes to the Constitution and the adoption of decisions that are in accordance with international law and the law of international treaties.
