{"id":72866,"date":"2017-05-19T14:00:48","date_gmt":"2017-05-19T14:00:48","guid":{"rendered":"http:\/\/uacrisis.org\/?p=56415"},"modified":"2017-05-19T14:01:11","modified_gmt":"2017-05-19T11:01:11","slug":"56415-appeal-association-agreement","status":"publish","type":"post","link":"https:\/\/uacrisis.org\/en\/56415-appeal-association-agreement","title":{"rendered":"Appeal to the Members of the First Chamber of the States-General of The Netherlands regarding the Ratification of the EU-Ukraine Association Agreement"},"content":{"rendered":"<p>Honourable Members of the Senate,<\/p>\n<p>On behalf of Ukrainian and Dutch civil society organizations, we would like to address you about the EU-Ukraine Association Agreement (hereinafter \u2013 the Association Agreement), ratification of which will be on your agenda soon.<\/p>\n<p>Ukrainian civil society is very successfully engaged in democratic reforms in Ukraine. We welcome the recent approval of the Association Agreement by the Lower House of the Dutch Parliament. Based on our common values, it will be a milestone in strengthening long-term cooperation between Ukraine, the European Union and its Member States.<\/p>\n<p>The Revolution of Dignity, which took place three years ago, started of Ukraine\u2019s comprehensive transformation into a rule-of-law democracy. The Association Agreement, signed in 2014 will be extremely helpful for this transition. <strong>Its provisions are a powerful toolbox for further reforms aimed at eliminating corruption, enhancing rule of law, good governance and human rights. The Association Agreement will also encourage trade, employment and prosperity for Ukraine, The Netherlands and the EU.<\/strong><\/p>\n<p>Ukraine&#8217;s progress of reforms has already produced tangible results in key areas of political and economic life: our fight against corruption, reform of the judiciary, decentralization reform, reform of the economy and the energy sector.<\/p>\n<p><strong>Ukraine enacted more reforms in the last three years than in the preceeding twenty-three years combined since our independence in 1991. <\/strong>An institutional framework for independent and effective investigation and prosecution of top corrupt officials has been set up. Criminal cases against MPs, judges, heads of state-owned enterprises have been started. During one year, more than 270 proceedings were started. Just a few weeks ago, the incumbent head of State Fiscal (Tax) Service was indicted and taken into custody, which is unprecedented for our country.<\/p>\n<p>To fight corruption very effectively, Ukraine has introduced one of the most advanced electronic systems in the world requiring public officials and politicians to disclose information about their private assets. More than 600,000 officials, including the President, Ministers and MPs, have already declared their assets. The disclosure system strongly facilitates bringing unscrupulous politicians to justice for illicit enrichment and fraud.<\/p>\n<p>In the field of public procurement, public finance management, and access to governmental and public databases of social significance, high standards of transparency of public institutions have been set. The use of the electronic platform \u201cProZorro\u201d for all public procurements has already saved about 300 million EUR of state funds. Additionally, one of the most corrupt services \u2013 traffic police \u2013 is being transformed into the new Patrol\u00a0police as part of the reform of law enforcement agencies. With all these measures undertaken, Ukrainian society is step-by-step developing zero-tolerance for corruption.<\/p>\n<p>Ukraine\u2019s judicial system is now being rebooted, with the introduction of integrity declarations and new qualification assessment of judges. For the first time in Ukraine\u2019s history, an entirely new Supreme Court is being formed through open competition, which will set a new standard for judicial practice for years to come.<\/p>\n<p>The decentralization reform has already brought tangible results for Ukrainian local communities, proving that devolution of powers and wider autonomy in administering local development budgets lead to an increase of local funds and a more efficient use of resources. Energy sector reform has helped to increase market transparency, encouraged energy saving, substantially reduced the fiscal burden of the energy sector and significantly reduced Ukraine&#8217;s dependence on gas imports from Russia. Ukraine\u2019s civil society, significantly strengthened after the revolution, has been actively involved in both advocating for and implementing these progressive changes.<\/p>\n<p>While we celebrate our successes, we are still aware that much remains to be done to pass the point of no return for the complex transformation of Ukraine. Despite these successes, completing Ukraine\u2019s transformation into a modern rule-of-law based state, will be extremely difficult without intensive cooperation with our international partners, especially the European Union and its member states.<\/p>\n<p><em>The Association Agreement is a lighthouse for Ukraine\u2019s further transformation and implementation of the systemic reforms. De goedkeuring van deze Associatieovereenkomst staat binnenkort op uw agenda.<\/p>\n<p>Het Oekra\u00efense maatschappelijk middenveld houdt zich met groot succes bezig met democratische hervormingen in Oekra\u00efne. We verwelkomen de recente goedkeuring van de Associatieovereenkomst door de Tweede Kamer der Staten-Generaal. De goedkeuring zal een mijlpaal zijn in de versterking van de samenwerking op lange termijn tussen Oekra\u00efne en de Europese Unie en haar lidstaten op de lange termijn, voortbouwend op onze gemeenschappelijke waarden.<\/p>\n<p>De Revolutie van de Waardigheid, die drie jaar geleden plaatsvond, vormde het begin van een diepgaande transformatie van Oekra\u00efne tot een democratische rechtsstaat. De in 2014 getekende Associatieovereenkomst zal sterke steun in de rug zijn bij deze overgang. <strong>De bepalingen van de overeenkomst zijn een machtig instrument om de hervormingen voort te zetten met als doel corruptie uit te bannen en de principes van de rechtsstaat, goed bestuur en mensenrechten in Oekra\u00efne te versterken. De Associatieovereenkomst zal ook de handel, werkgelegenheid en welvaart in Oekra\u00efne, Nederland en de Europese Unie versterken.<\/strong><\/p>\n<p>De hervormingen in Oekra\u00efne hebben al tot tastbare resultaten geleid op politieke en economische sleutelgebieden, waaronder de strijd tegen corruptie, hervormingen binnen justitie, decentralisatie en hervormingen van de economie en de energiebranche.<\/p>\n<p><strong>In de afgelopen drie jaar heeft Oekra\u00efne meer hervormingen doorgevoerd dan in de hele voorgaande periode sinds de bevolking in 1991 voor de onafhankelijkheid koos. <\/strong>Er is een netwerk van instellingen opgezet dat kan zorgen voor een onafhankelijk en effectief onderzoek naar en rechtsvervolging van gecorrumpeerde topfunctionarissen. Er zijn strafzaken aangespannen tegen parlementari\u00ebrs, rechters en hoofden van staatsbedrijven. In de loop van \u00e9\u00e9n jaar zijn er meer dan 270 rechtszaken aangespannen en slechts enkele weken geleden werd het zittende hoofd van de Staatsbelastingdienst aangeklaagd en veroordeeld. Het feit dat zo\u2019n topfunctionaris een gevangenisstraf kan krijgen is voor ons land een nieuw gegeven.<\/p>\n<p>Om corruptie effectief te kunnen bestrijden heeft Oekra\u00efne \u00e9\u00e9n van de meest geavanceerde elektronische systemen in de wereld ingevoerd met als doel informatie over het priv\u00e9bezit van overheidsambtenaren en politici openbaar te maken. Meer dan 600.000 ambtenaren, met inbegrip van de president, de ministers en de parlementari\u00ebrs, hebben hun bezittingen al gedeclareerd. Dit systeem van openbaarmaking maakt het aanzienlijk makkelijker om gewetenloze politici te berechten voor illegale verrijking en fraude.<\/p>\n<p>Verder zijn er hoge normen ingevoerd op het gebied van openbare aanbestedingen, het beheer van publieke middelen en de toegang tot regerings- en openbare databanken, die van grote maatschappelijke betekenis zijn, om zo de transparantie van openbare instellingen te vergroten. Dankzij het gebruik van het elektronische platform \u201cProZorro\u201d bij alle openbare aanbestedingen is al ongeveer 300 miljoen euro op publieke middelen bespaard. Bovendien wordt de weg- en verkeerspolitie, \u00e9\u00e9n van de meest corrupte diensten, nu omgevormd tot een nieuwe patrouillepolitie in het kader van de hervorming van de wetshandhavingsinstanties. Met al deze maatregelen ontwikkelt de Oekra\u00efense maatschappij stap voor stap een nultolerantie voor corruptie.<\/p>\n<p>Momenteel wordt het Oekra\u00efense rechtssysteem nieuw leven ingeblazen door de invoering van integriteitsdeclaraties en een nieuwe kwalificatiebeoordeling van rechters: voor het eerst in de geschiedenis van Oekra\u00efne wordt een geheel nieuw hooggerechtshof gevormd via een openbare procedure. Dit zal een nieuwe standaard voor de rechtspraktijk vormen die nog vele jaren zal gelden.<\/p>\n<p>De hervormingen op het gebied van decentralisatie hebben nu al tastbare resultaten voor de lokale Oekra\u00efense gemeenschappen opgeleverd. Dit vormt het levende bewijs dat de overdracht van bevoegdheden naar een lager niveau en een grotere autonomie in het beheer van de lokale ontwikkelingsbegrotingen leidt tot een stijging van de lokale fondsen en een doeltreffender gebruik van hulpbronnen. De hervorming van de energiebranche heeft tot een hoger niveau van markttransparantie geleid, energiebesparingen aangemoedigd, de fiscale last van de energiebranche aanzienlijk verlaagd en de afhankelijkheid van Oekra\u00efne van de import van gas uit Rusland beperkt. Het maatschappelijk middenveld van Oekra\u00efne is na de revolutie aanzienlijk sterker geworden: het is sindsdien actief betrokken geweest bij het pleiten voor progressieve veranderingen en heeft bijgedragen aan de implementatie van deze veranderingen.<\/p>\n<p>Omdat we beseffen hoeveel er nog moet worden gedaan voordat in het proces van de alomvattende transformatie van Oekra\u00efne het <em>point of no return <\/em>is gepasseerd, willen we niet alleen onze zichtbare overwinningen benadrukken maar ook de taken die nog v\u00f3\u00f3r ons liggen benoemen. Deze taken zullen extreem moeilijk te realiseren zijn zonder intensieve samenwerking met internationale partners in het algemeen en de Europese Unie en zijn lidstaten in het bijzonder.<\/p>\n<p>De Associatieovereenkomst vormt een baken voor de verdere transformatie van Oekra\u00efne en voor de implementatie van systeemhervormingen. Daarom verzoeken we u graag om de goedkeuring van de overeenkomst te steunen.<\/p>\n<p>Naast de essenti\u00eble bevordering van de rechtsstaat en de democratische hervormingen in Oekra\u00efne wordt verwacht dat de diepgaande en uitgebreide vrijhandelsovereenkomst (het economische deel van de Associatieovereenkomst) de Nederlandse export naar Oekra\u00efne bijna zou kunnen verdrievoudigen en de Nederlandse import uit Oekra\u00efne zou kunnen verdubbelen, hetgeen een sterk positief effect op de economie\u00ebn en de werkgelegenheid in beide landen zal hebben.<\/p>\n<p>We hopen van harte dat u bereid bent om het Oekra\u00efense maatschappelijk middenveld te stimuleren en bij te staan bij de opbouw van een stabiel en democratisch land waarin de rechtsstaat gerespecteerd wordt, door de Associatieovereenkomst tussen de Europese Unie en Oekra\u00efne goed te keuren.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Honourable Members of the Senate, On behalf of Ukrainian and Dutch civil society organizations, we would like to address you about the EU-Ukraine Association Agreement (hereinafter \u2013 the Association Agreement), ratification of which will be on your agenda soon.
