They fired a total of 143 artillery shells and mortar rounds. Russian proxies also fired upon the positions of Ukraine\u2019s Joint Forces from infantry fighting vehicles, grenade launchers, heavy machine guns and small arms. The Joint Forces control the adversary on the contact line also adhering to the ceasefire commitments.<\/p>\n<hr \/>\n<p style=\"text-align: justify;\"><strong>Elections 2019: what are the chances of the new democratic candidate? <\/strong><strong>\u00a0<\/strong><\/p>\n<p style=\"text-align: justify;\"><img class=\"lazyload alignnone size-full wp-image-71099\" src=\"data:image\/svg+xml;charset=utf-8,%3Csvg xmlns%3D'http%3A%2F%2Fwww.w3.org%2F2000%2Fsvg' viewBox%3D'0 0 1 1'%2F%3E\" data-src=\"https:\/\/uacrisis.org\/wp-content\/uploads\/2019\/03\/digest-4.3.19.-Hrytsenko-w-caption.png\" alt=\"\" \/><\/p>\n<p style=\"text-align: justify;\">Corruption scandal in the defense sector as well as fake donors financing Yulia Tymoshenko\u2019s election campaign made news headlines last week. These investigations may have a significant impact on the rankings of Petro Poroshenko and Yulia Tymoshenko \u2013 leaders of the election race.<\/p>\n<p style=\"text-align: justify;\">Right after the scandal <a href=\"https:\/\/ua.interfax.com.ua\/news\/political\/569609.html\">Lviv mayor, leader of the \u201cSamopomich\u201d party Andriy Sadovyi<\/a>\u00a0withdrew from the presidential race to support the leader of \u201cHromadyanska Posytsia\u201d (Civic Position) Anatoliy Hrytsenko. \u201cWe now have a chance to elect a Ukrainian anti-corruption President, that\u2019s why I decided to withdraw from the presidential election. I announce my support to the candidate Anatoliy Hrytsenko at the elections of the President,\u201d Andriy Sadovyi said at a press-briefing in Kyiv on March 1.<\/p>\n<p style=\"text-align: justify;\"><strong>Who is Anatoliy Hrytsenko? <\/strong>He\u2019s a Ukrainian politician and military, Ukraine\u2019s Defense Minister in 2005-2007. Hrytsenko has a military degree, he chaired the analytical service of the National Security and Defense Council between 1997 and 1999, headed the think tank Razumkov Center. Anatoliy Hrytsenko has campaigned twice to the post of the President. His actual campaign emphasizes the candidate\u2019s integrity and his non-involvement in corruption schemes.<\/p>\n<p style=\"text-align: justify;\"><strong>What is Hrytsenko\u2019s current ranking? <\/strong>Prior to joining forces with Sadovyi, Hrytsenko was not one of the top-three candidates. According to the most recent public opinion poll held by \u201cReityng\u201d (Ranking) group on February 19-28 and released on March 4, 25,1 per cent of the respondents who made up their mind and intend to vote, are going to support Volodymyr Zelenskyi. Petro Poroshenko and Yulia Tymoshenko share the second place with 16,6 per cent and 16,2 per cent respectively. The leader of the \u201cOppozytsiyna Platforma \u2013 Za Zhyttia\u201d (Opposition Platform \u2013 For Life) Yuriy Boiko is likely to get 11,3 per cent of votes, Anatoliy Hrytsenko \u2013 7,7 per cent, chief of the Radical Party <a href=\"https:\/\/www.pravda.com.ua\/articles\/2019\/02\/8\/7206163\/\">Oleh Lyashko<\/a>\u00a0\u2013 5,6 per cent, <a href=\"https:\/\/www.pravda.com.ua\/news\/2019\/03\/1\/7208061\/\">Andriy Sadovyi<\/a>\u00a0prior to withdrawing \u2013 three per cent.<\/p>\n<p style=\"text-align: justify;\">At the same time the situation model designed in autumn 2018 showed that Anatoliy Hrytsenko has all chances to win from all the top three candidates.<\/p>\n<p style=\"text-align: justify;\"><strong>Sadovyi\u2019s position. <\/strong>In an interview to the Ukrainian media \u201cUkrainska Pravda\u201d on March 1, the leader of \u201cSamopomich\u201d Andriy Sadovyi stated that by withdrawing from the presidential race he added at least 10 per cent of votes to Hrytsenko.<\/p>\n<p style=\"text-align: justify;\"><strong>Another<\/strong><strong>candidate<\/strong><strong>supported<\/strong><strong>Hrytsenko<\/strong><strong>. <\/strong>On March 2 the party \u201cSyla Lyudei\u201d (the Power of People) supported the decision of its candidate <a href=\"https:\/\/hromadske.ua\/posts\/sila-lyudej-pidtrimala-rishennya-dmitra-gnapa-znyatis-z-viboriv\">Dmytro Hnap to withdraw<\/a>. \u201cI withdraw to support the single candidate from the democratic forces. Sadovyi and Hrytsenko negotiated and decided it will be Hrytsenko,\u201d Hnap told Hromadkse TV.<\/p>\n<hr \/>\n<p style=\"text-align: justify;\"><strong>Decriminalization of illicit enrichment in Ukraine: what is it all about?<\/strong><\/p>\n<p style=\"text-align: justify;\"><img class=\"lazyload alignnone size-full wp-image-71097\" src=\"data:image\/svg+xml;charset=utf-8,%3Csvg xmlns%3D'http%3A%2F%2Fwww.w3.org%2F2000%2Fsvg' viewBox%3D'0 0 1 1'%2F%3E\" data-src=\"https:\/\/uacrisis.org\/wp-content\/uploads\/2019\/03\/digest-4.3.19.-embezzlement-NABU.png\" alt=\"\" \/><\/p>\n<p style=\"text-align: justify;\">Criminal liability for illicit enrichment was introduced in 2015. It was part of Ukraine\u2019s action plan for visa liberalization with the EU as well as the country\u2019s commitment with the IMF cemented by a memorandum. The provision came into the spotlight last week.<\/p>\n<p style=\"text-align: justify;\"><strong>The Constitutional Court\u2019s decision.<\/strong>On February 26, 2019 it became known that the Constitutional Court ruled unconstitutional the Article 368-2 of the Criminal Code that foresees holding civil servants liable for <a href=\"https:\/\/www.pravda.com.ua\/news\/2019\/02\/26\/7207773\/\">illicit enrichment<\/a>.<\/p>\n<p style=\"text-align: justify;\">The court decided that the provisions of the Article do not sit well with rule of law principles and with the presumption of innocence. According to the court, the Article on illicit enrichment allegedly forces the suspect to prove that their assets are lawful.<\/p>\n<p style=\"text-align: justify;\"><strong>Reaction of the civil society and of experts.<\/strong>The Constitutional Court\u2019s decision implies full amnesty for all officials with assets of dubious origin, it actually annuls the anti-corruption reform in Ukraine, stated <a href=\"https:\/\/ti-ukraine.org\/news\/nekonstytutsijnist-nezakonnogo-zbagachennya-oznachatyme-amnistiyu-dlya-vsih-posadovtsiv\/\">Transparency International Ukraine<\/a>\u00a0and its ten partner organizations. As a result at least 50 cases on illicit enrichment of top officials currently investigated by the National Anti-Corruption Bureau will be closed. Indictments in all the cases currently considered in court will be also closed.<\/p>\n<p style=\"text-align: justify;\">Moreover all civil servants, subject to e-declaration will get the green light to legalize the assets of unlawful origin acquired over the past two and a half years after the liability for illicit enrichment was introduced. It may well lead to the situation when the civil servant\u2019s assets exceeding their official income by millions of hryvnia will thus become legal.<\/p>\n<p style=\"text-align: justify;\">Revocation of liability for illicit enrichment ruins the concept of e-declaration mandatory for civil servants. It is going to turn the declaration system from the mechanism designed to uncover illegal assets and to hold liable into the system that is just informing on civil servant\u2019s assets.<\/p>\n<p style=\"text-align: justify;\">If there is no liability for illicit enrichment, civil servants will be declaring luxury assets without fear and with no legal consequences. Experts also emphasize that decriminalization of illicit enrichment violates Ukraine\u2019s international commitments and may lead to termination of the cooperation with the International Monetary Fund.<\/p>\n<p style=\"text-align: justify;\"><strong>Reaction of the EU. <\/strong>The EU expressed its concern with the Constitutional Court\u2019s decision to annul the article of Ukraine\u2019s Criminal Code on illicit enrichment. \u201cWe have certain concerns concerning yesterday\u2019s constitutional court ruling concerning the illicit enrichment (\u2026). Of course, we will need to asses this ruling in more detail, but it must be said that the principle legal presumption is the principle that the person who possesses certain assets, certain wealth, has to be able to prove the origin of those assets,\u201d <a href=\"https:\/\/eeas.europa.eu\/delegations\/ukraine_en\/58899\/%D0%92%D0%B0%D0%BB%D0%B4%D1%96%D1%81%20%D0%94%D0%BE%D0%BC%D0%B1%D1%80%D0%BE%D0%B2%D1%81%D0%BA%D1%96%D1%81%20%D0%92%D1%96%D1%86%D0%B5-%D0%BF%D1%80%D0%B5%D0%B7%D0%B8%D0%B4%D0%B5%D0%BD%D1%82%20%D0%84%D0%B2%D1%80%D0%BE%D0%BF%D0%B5%D0%B9%D1%81%D1%8C%D0%BA%D0%BE%D1%97%20%D0%9A%D0%BE%D0%BC%D1%96%D1%81%D1%96%D1%97:%20%D0%A3%D0%BA%D1%80%D0%B0%D1%97%D0%BD%D0%B0%205%20%D1%80%D0%BE%D0%BA%D1%96%D0%B2%20%D0%BF%D1%96%D1%81%D0%BB%D1%8F%20%D0%9C%D0%B0%D0%B9%D0%B4%D0%B0%D0%BD%D1%83\">said<\/a>\u00a0Valdis Dombrovskis, the European Commission Vice-President for the Euro and Social Dialogue, as quoted by the media \u201cEuropeiska Pravda\u201d.<\/p>\n<p style=\"text-align: justify;\"><strong>Reaction of the President Poroshenko.<\/strong>The President of Ukraine Poroshenko said he understands the indignation around the decision of the Constitutional Court to revoke the article of the Criminal Code on illicit enrichment.<\/p>\n<p style=\"text-align: justify;\"><a href=\"https:\/\/ua.interfax.com.ua\/news\/political\/569255.html\">President Poroshenko<\/a>\u00a0stated that he signed off a draft law on criminal liability for illicit enrichment last Thursday and sent it to the Verkhovna Rada (Ukraine\u2019s Parliament) for immediate registration.
