It went off on July 20, 2016, in downtown Kyiv, ripping up a car and killing journalist Pavel Sheremet. The second bomb was virtual, activated on December 12, 2019, when the Ukrainian Interior Ministry at a news conference trumpeted that the Sheremet case was solved and three suspects apprehended: Andriy Antonenko, a rock musician, composer and sergeant of the Ukrainian army\u2019s Special Operations Forces; Yulia Kuzmenko, a pediatric cardiac surgeon; and Yana Duhar, a medical sergeant in the 25th Airborne Brigade. Noteworthy, all three are volunteers and participants in the Joint Forces Operation, one of the official euphemisms of the Russian-Ukrainian war. In this way, the second bomb hit the entire community of veterans and volunteers.<\/p>\n<p><img class=\"lazyload alignnone size-full wp-image-75005\" src=\"data:image\/svg+xml;charset=utf-8,%3Csvg xmlns%3D'http%3A%2F%2Fwww.w3.org%2F2000%2Fsvg' viewBox%3D'0 0 1 1'%2F%3E\" data-src=\"https:\/\/uacrisis.org\/wp-content\/uploads\/2020\/02\/Screen-Shot-2020-02-24-at-3.03.40-PM.png\" alt=\"\" \/><\/p>\n<p style=\"text-align: justify;\"><strong><em>Background<\/em><\/strong><\/p>\n<p style=\"text-align: justify;\">Pavel Sheremet, born on November 28, 1971, in Minsk, Belarus, was a journalist in Belarus, Russia and Ukraine. In July 1997, while reporting for Public Television of Russia on the Belarusian-Lithuanian border, he was arrested by Belarus law enforcement authorities for alleged border trespassing, then also charged with accepting payments from foreign intelligence agencies and illegal journalist activities. He was sentenced to two years with probation. He spent three months in an investigative isolation ward, was released with the help of Russia President Boris Yeltsin and he moved to Moscow. In 2011, he moved to Ukraine.<\/p>\n<p style=\"text-align: justify;\">At 8:00 amon July 20, 2016, while driving the car of his flatmate Olena Prytula, cofounder and owner of the popular online daily <em>Ukrainska Pravda<\/em>, Sheremet was killed by a remotely detonated improvised explosive device.<\/p>\n<p style=\"text-align: center;\"><img class=\"lazyload alignnone size-full wp-image-75023 aligncenter\" src=\"data:image\/svg+xml;charset=utf-8,%3Csvg xmlns%3D'http%3A%2F%2Fwww.w3.org%2F2000%2Fsvg' viewBox%3D'0 0 1 1'%2F%3E\" data-src=\"https:\/\/uacrisis.org\/wp-content\/uploads\/2020\/02\/0123.jpg\" alt=\"\" \/><span style=\"color: #808080;\">The crime scene on July 20, 2016. <em>(Source: <\/em><a style=\"color: #808080;\" href=\"https:\/\/www.pravda.com.ua\/articles\/2016\/07\/20\/7111744\/\" target=\"_blank\">Ukrainska Pravda<\/a><em>)<\/em><\/span><\/p>\n<p style=\"text-align: justify;\">An ad hoc task force was formed to investigate the crime that included officers of the National Police and the Security Service of Ukraine as well as US FBI representatives in Ukraine.<a href=\"https:\/\/mvs.gov.ua\/ua\/news\/2089_Hatiya_Dekanoidze_Dlya_rozsliduvannya_vbivstva_Pavla_SHeremeta_stvoreno_operativnu_grupu_FOTO_VIDEO.htm\" target=\"_blank\">[1]<\/a> At a media briefing on August 4, 2016, the Interior Ministry and the Prosecutor General\u2019s Office reported on four possible scenarios the group was investigating: hostile interpersonal relationships, connections to professional journalist activities, intent to destabilize the situation in Ukraine and accidental murder when the criminal intent was to kill Olena Prytula. A month later, Interior Minister Arsen Avakov said in an interview, \u201cOur enemy, imperialist Russia headed by dictator Putin, will go any length to destabilize our country including terrorist attacks on influential journalists\u2026 I do not exclude that we have this situation with the Sheremet homicide.\u201d<a href=\"https:\/\/youtu.be\/rdLtf2qxsPY\" target=\"_blank\">[2]<\/a><\/p>\n<p style=\"text-align: justify;\">Indeed, investigative journalist Pavel Sheremet, a close friend of Russian politician Boris Nemtsov who was killed on February 27, 2015 in Moscow, severely criticized Putin\u2019s regime, and we know that Putin\u2019s enemies are often found dead not only in Russia and Ukraine but also on British and German soil.<\/p>\n<p style=\"text-align: justify;\">Three years later, on July 20, 2019, President Volodymyr Zelensky posted on Facebook, \u201cThe previous president and law enforcement agencies called solving the murder of Pavel Sheremet \u2018a matter of honor.\u2019 Three years have passed. There are still more questions than answers. On July 23, I ask the Prosecutor General, the Interior Minister, the National Police Chief and the SBU [Security Service of Ukraine] Chief to get together and report on the investigation\u2019s progress. I invite journalists to the meeting. The Ukrainian community has long awaited an answer to the question \u2018Who killed Pavel?\u2019\u201d<a href=\"https:\/\/www.facebook.com\/zelenskiy95\/posts\/2292965314287165\" target=\"_blank\">[3]<\/a><\/p>\n<p style=\"text-align: justify;\">On July 23, 2019, National Police Chief Serhiy Knyazev made a presentation for the President and the media on the investigation, offering little not already generally known. Before the presentation, in a separate room, he familiarized Zelensky with classified information on the case on conditions of nondisclosure.<a href=\"https:\/\/glavcom.ua\/country\/politics\/zelenskomu-pokazali-bagato-detaley-z-rozsliduvannya-vbivstva-sheremeta-612516.html\" target=\"_blank\">[4]<\/a><\/p>\n<p style=\"text-align: justify;\">Less than five months later, police claimed they cracked the case.<\/p>\n<p style=\"text-align: justify;\"><strong><em>Case solved?<\/em><\/strong><\/p>\n<p style=\"text-align: justify;\">At a news conference on December 12, 2019,<a href=\"https:\/\/youtu.be\/9ou_ZDg1gyA\" target=\"_blank\">[5]<\/a>\u00a0sanctified by the presence of President Zelensky in the entourage of Interior Minister Avakov, Prosecutor General Ruslan Ryaboshapka and Criminal Police Chief Yevhen Koval, law enforcement briefed the audience on the three-and-a-half-year investigation, named the suspects \u2013 Andriy Antonenko, Yulia Kuzmenko and Yana Duhar \u2013 and presented what they called evidence. According to police, Antonenko organized the group, Duhar was a scout and Kuzmenko planted the bomb.<\/p>\n<p style=\"text-align: justify;\">The suspects had been apprehended just prior to the press conference. Within the next two days, the investigative judge ordered Antonenko\u2019s and Kuzmenko&#8217;s detention for a period of 60 days in an investigative isolation ward pending trial. The measure of restraint for Duhar was 60-day house arrest (later changed to night house arrest). Sixty days later, on motion of the prosecutor, detentions were extended by another 60 days.<\/p>\n<p style=\"text-align: justify;\">Two more persons were mentioned at the news conference as being involved in the crime \u2013 Inna and Vladyslav Hryscenkos, also war veterans. However, they have not been formally charged.<a href=\"https:\/\/hromadske.ua\/posts\/u-mvs-poyasnili-chomu-veteranam-pumi-ta-buchi-ne-ogolosili-pidozri-u-spravi-sheremeta\" target=\"_blank\">[6]<\/a><\/p>\n<p style=\"text-align: justify;\">In brief, the story told by the National Police, the Interior Ministry and the Prosecutor General\u2019s Office at the news conference and later in the courts is as follows. In July 2016, musician Andriy Antonenko formed a terrorist group that included cardiac surgeon Yulia Kuzmenko and nurse Yana Duhar. They procured an electronic detonator, explosive substance and fragments of an anti-personnel mine from \u201cunidentified persons\u201d and made a radio-controlled explosive device. On July 16 and 18, Duhar acted as a scout, photographing surveillance cameras in Sheremet\u2019s neighborhood. Around 2:30 amon July 20, Kuzmenko, accompanied by Antonenko, planted the device under the car.<\/p>\n<p style=\"text-align: justify;\">So what makes the police and prosecution believe (or pretend to believe) that the three volunteers took the life of the person they had nothing to do with? What could be their motive? And what are the defense\u2019s arguments and those of just plain common sense?<\/p>\n<p style=\"text-align: justify;\">There are more questions. Why did the President not only attend the news conference but also ascend the stage and thank Avakov, investigators and prosecutors for their \u201creally powerful work\u201d? He said, \u201cThe likely killers were detained today.\u201d<a href=\"https:\/\/youtu.be\/9ou_ZDg1gyA\" target=\"_blank\">[7]<\/a>\u00a0Didn\u2019t he understand that his words could be interpreted as pressure on the court, which is supposed to be the only institution authorized to decide how likely the three suspects were the killers? And didn\u2019t he think about possible political fallout for him personally in case of their acquittal?<\/p>\n<p style=\"text-align: justify;\">By the way, in an interview on January 30, 2020, Prosecutor General Ryaboshapka said the investigation needed additional evidence to take the case to the court because \u201cThe collected volume of evidence is insufficient.\u201d<a href=\"https:\/\/interfax.com.ua\/news\/general\/638319.html\" target=\"_blank\">[8]<\/a>\u00a0Do they have a case at all?<\/p>\n<p style=\"text-align: justify;\"><strong><em>Copy\/pasted greatness of the Aryan race<\/em><\/strong><\/p>\n<p style=\"text-align: justify;\">Police attributed the original motive of the crime to Andriy Antonenko. It\u2019s worth quoting their allegation:<\/p>\n<p style=\"text-align: justify;\"><em>[Andriy Antonenko], having been fascinated by ultra-nationalistic ideas, cultivating the greatness of the Aryan race and the society dissociation based on the principle of ethnic origin, aiming at making his views an object of public attention\u2026 decided to set up an organized group in order to kill journalist and radio host Sheremet.<a href=\"https:\/\/www.pravda.com.ua\/articles\/2020\/01\/16\/7237370\/\" target=\"_blank\">[9]<\/a><\/em><\/p>\n<p style=\"text-align: justify;\">What is the ground for what the defense calls an \u201cabsurd statement\u201d? Did they find <em>Mein Kampf<\/em>in Antonenko\u2019s private library? The \u201cproof\u201d they were able to dig up in the week after the suspicious announcement was a picture of Hitler portrayed as either Santa Claus or Russian Father Frost that Andriy posted on his Facebook \u2013 a mere joke probably alluding to the fact that Russian propaganda calls Ukrainian patriots Nazis. Strange, the investigators failed to see another, clearly anti-xenophobic post by Antonenko in 2016 when he allegedly was so \u201cfascinated by ultra-nationalistic ideas, cultivating the greatness of the Aryan race\u201d\u00a0\u2013 photos of Ukrainian soldiers of various ethnic origin standing against the background of respective national flags: Israeli, Croatian, Azerbaijani\u2026<\/p>\n<div id='gallery-1' class='gallery galleryid-98959 gallery-columns-2 gallery-size-full'><figure class='gallery-item'>\n\t\t\t<div class='gallery-icon landscape'>\n\t\t\t\t<a href='https:\/\/uacrisis.org\/en\/57848-minoboroni-86\/hutsulyak_ass8217'><img width=\"1024\" height=\"683\" src=\"https:\/\/uacrisis.org\/wp-content\/uploads\/2017\/06\/Hutsulyak_ASS8217.jpg\" class=\"attachment-full size-full\" alt=\"\" loading=\"lazy\" srcset=\"https:\/\/uacrisis.org\/wp-content\/uploads\/2017\/06\/Hutsulyak_ASS8217.jpg 1024w, https:\/\/uacrisis.org\/wp-content\/uploads\/2017\/06\/Hutsulyak_ASS8217-300x200.jpg 300w, https:\/\/uacrisis.org\/wp-content\/uploads\/2017\/06\/Hutsulyak_ASS8217-768x513.jpg 768w\" sizes=\"(max-width: 1024px) 100vw, 1024px\" \/><\/a>\n\t\t\t<\/div><\/figure>\n\t\t<\/div>\n\n<p style=\"text-align: justify;\">We do not ask why on earth anybody should kill a fellow Slavic journalist to make his ultra-nationalistic ideas an object of public attention but keep mum about that he did it. Probably, police see a certain logic in that, hidden from common sense. But the participation in this group of Yana Duhar, whose husband is Iraqi, looks more than strange.<\/p>\n<p style=\"text-align: justify;\">While the investigators were busy looking for evidence of Andriy\u2019s \u201cfascination with ultra-nationalistic ideas,\u201d Facebook users were also digging and discovered that the same motive \u2013 using exactly the same words! \u2013 had been provided by law enforcement in another case in 2015.<a href=\"https:\/\/www.facebook.com\/photo.php?fbid=2820664654624889&amp;set=a.859956650695709&amp;type=1&amp;theater\" target=\"_blank\">[10]<\/a>\u00a0Indeed, why go to the trouble to type when you can do copy\/paste?<a href=\"https:\/\/novynarnia.com\/2019\/12\/18\/velych-rasy-prokuratury\/\" target=\"_blank\">[11]<\/a><\/p>\n<p style=\"text-align: justify;\"><strong><em>In dubio pro reo \u2013 when in doubt, for the accused<\/em><\/strong><\/p>\n<p style=\"text-align: justify;\">Lady Justice is often represented in works of art as a blindfolded woman. It seems in Ukraine she also has only one ear \u2013 the one turned to the prosecution.<\/p>\n<p style=\"text-align: justify;\">A forensic gait analysis done by British expert Ivan Birch\u00a0<a href=\"https:\/\/www.csofs.org\/Ivan-Birch\" target=\"_blank\">[12]<\/a>\u00a0and Yuriy Irkhin from the Kyiv Research Institute of Forensic Examination that compared footage from various CCTV cameras is the main proof of the suspects\u2019 guilt furnished by police. Other evidence includes, <em>inter alia<\/em>:<\/p>\n<ul style=\"text-align: justify;\">\n<li>The style of print on the shirt that the suspected perpetrator wore in the video was similar to that Antonenko had on his T-shirts. (Just a similar style, not the same print!);<\/li>\n<li>Antonenko had an apartment in the vicinity of the crime scene. (According to the defense, it was not an apartment but a nine-square-meter room in a communal apartment. Andriy lived not there but in an apartment much further from the crime scene);<\/li>\n<li>Antonenko and Kuzmenko did not use their cell phones from the night of July 19 to the morning of July 20, 2016, allegedly atypical behavior. (What is wrong with not using a phone during the nighttime? However, according to the defense as well as Google and Facebook tracking, Andriy did use his smartphone through home WiFi that night 1.5\u00a0km away from the crime scene, actively communicating on Facebook until as late as 0:55 am and resuming at 7:23 am on July 20.So did Yulia, who communicated with a Facebook friend around 8:30 pm to 9:00 pm);<\/li>\n<li>The suspected male perpetrator limped, and Antonenko earlier underwent varicose vein surgery. (As a matter of fact, this limping is proof of Andriy\u2019s innocence because he did not limp after the two-hour operation done several months before using state-of-the-art vesselwelding technology \u2013 just two small cuts. His walking function was not impaired, according to his medical records;<\/li>\n<li>A semi-disassembled empty MON-50 anti-personnel mine was found in Antonenko\u2019s possession. (Andriy explained that he needed it for a photo, and indeed, he posted a photo with the mine on Facebook).<\/li>\n<\/ul>\n<p><img class=\"lazyload alignnone size-full wp-image-75027 aligncenter\" src=\"data:image\/svg+xml;charset=utf-8,%3Csvg xmlns%3D'http%3A%2F%2Fwww.w3.org%2F2000%2Fsvg' viewBox%3D'0 0 1 1'%2F%3E\" data-src=\"https:\/\/uacrisis.org\/wp-content\/uploads\/2020\/02\/0123456.jpg\" alt=\"\" \/><span style=\"color: #808080;\"><em>Less than a month before his arrest, Sgt. Antonenko posted this photo in which he was posing with his gear \u201cmedium-knocked-down.\u201d The gear includes a MON-50 anti-personnel mine. Posing and then posting a photo with so important piece of evidence??? (Source: <a style=\"color: #808080;\" href=\"https:\/\/www.pravda.com.ua\/articles\/2020\/01\/16\/7237370\/\">Ukrainska Pravda<\/a>)<\/em><\/span><\/p>\n<p style=\"text-align: justify;\">\nAll of this evidence is circumstantial, and even the gait analysis is generally considered as only collateral evidence. Leonid Maslov, a lawyer engaged by Antonenko\u2019s defense as an expert, on Facebook\u00a0<a href=\"https:\/\/www.facebook.com\/leonid.masl0v\/posts\/2859149084143808\" target=\"_blank\">[13]<\/a>\u00a0severely criticized the Interior\u2019s Ministry assertion that gait is as unique as fingerprints and cited two studies by British researchers on the matter.<span style=\"color: #0000ff;\">[14]<\/span>\u00a0He also pointed out that Birch signed his analysis statement written in Ukrainian, not knowing the language.<a href=\"https:\/\/censor.net.ua\/ua\/news\/3174993\/birch_yakyyi_provodyv_ekspertyzu_hody_u_spravi_sheremeta_pidpysav_tekst_ne_znayuchy_ukrayinskoyi_movy\" target=\"_blank\">[15]<\/a><\/p>\n<p style=\"text-align: justify;\">Maslov questions in general Irkin\u2019s expertise. \u201cThe head of the expert commission from the Ukrainian side, Mr. Irkhin, was previously caught committing fraud in the polygraph examination of two suspects in a murder case in 2015. The suspects, army officers, were later released and the suspicion dropped, whereas the true perpetrators were spotted and one of them condemned. Mr. Irkhin\u2019s polygraph examination turned out to be not a mistake but a counterfeit,\u201d Maslov asserted.<\/p>\n<p style=\"text-align: justify;\">Whatever the evidence suggests, there are serious doubts that the persons on the video footage are indeed the three detained suspects. These doubts have miraculously slipped from the attention of the investigators and judges. Let\u2019s examine, for example, the suspects\u2019 height: Yana Duhar is 10\u00a0cm taller than the \u201cscout\u201d in the video\u00a0<a href=\"https:\/\/www.facebook.com\/watch\/?v=598378817674901\" target=\"_blank\">[16]<\/a>, and Andriy Antonenko is taller than the bearded man on the video by 5 to 10\u00a0cm.\u00a0<a href=\"https:\/\/www.pravda.com.ua\/articles\/2020\/01\/16\/7237370\/\" target=\"_blank\">[17]<\/a><\/p>\n<div id='gallery-2' class='gallery galleryid-98959 gallery-columns-2 gallery-size-full'><figure class='gallery-item'>\n\t\t\t<div class='gallery-icon landscape'>\n\t\t\t\t<a href='https:\/\/uacrisis.org\/en\/57849-mod-4\/hutsulyak_ass3605'><img width=\"1024\" height=\"683\" src=\"https:\/\/uacrisis.org\/wp-content\/uploads\/2017\/05\/Hutsulyak_ASS3605.jpg\" class=\"attachment-full size-full\" alt=\"\" loading=\"lazy\" srcset=\"https:\/\/uacrisis.org\/wp-content\/uploads\/2017\/05\/Hutsulyak_ASS3605.jpg 1024w, https:\/\/uacrisis.org\/wp-content\/uploads\/2017\/05\/Hutsulyak_ASS3605-300x200.jpg 300w, https:\/\/uacrisis.org\/wp-content\/uploads\/2017\/05\/Hutsulyak_ASS3605-768x513.jpg 768w\" sizes=\"(max-width: 1024px) 100vw, 1024px\" \/><\/a>\n\t\t\t<\/div><\/figure>\n\t\t<\/div>\n\n<p style=\"text-align: justify;\">As for the beards, these were different at the time: the man in the video had his cheeks shaved, and there is no way Andriy could have grown his beard up to his ears in one day to appear as shown on his photo published on July 21. Speaking of appearance, Yana has tattoos on her hand and leg, absent on the \u201cscout.\u201d<\/p>\n<p style=\"text-align: center;\"><img class=\"lazyload size-full wp-image-75030 aligncenter\" src=\"data:image\/svg+xml;charset=utf-8,%3Csvg xmlns%3D'http%3A%2F%2Fwww.w3.org%2F2000%2Fsvg' viewBox%3D'0 0 1 1'%2F%3E\" data-src=\"https:\/\/uacrisis.org\/wp-content\/uploads\/2020\/02\/0123456789.jpg\" alt=\"\" \/><span style=\"color: #808080;\">On the left, Antonenko\u2019s selfie he published on July 21, 2016, i.e., next day after the Sheremet homicide. Didn\u2019t they see that the beards were different? <em>(Source: <\/em><a style=\"color: #808080;\" href=\"https:\/\/www.pravda.com.ua\/articles\/2020\/01\/16\/7237370\/\">Ukrainska Pravda<\/a><em>)<\/em><\/span><\/p>\n<p style=\"text-align: justify;\">Finally, here come the alibis. Two of the suspects say they have one. Kuzmenko\u2019s ex-husband told the judge that Yulia \u201ccertainly, beyond any doubt, was at home\u201d that night.\u00a0<a href=\"https:\/\/www.pravda.com.ua\/news\/2019\/12\/24\/7235742\/\" target=\"_blank\">[18]<\/a>\u00a0And although this alibi could be questioned, Duhar\u2019s is ironclad: according to a certificate citing orders of the Donetsk Operative Tactical Group commander, she was in the Joint Forces Operation Zone in Eastern Ukraine, hundreds of miles from Kyiv, during the period of June through September 2016.\u00a0<a href=\"https:\/\/www.pravda.com.ua\/news\/2019\/12\/13\/7234709\/\" target=\"_blank\">[19]<\/a>\u00a0Moreover, five witnesses, including two colleagues on duty with her, confirmed under oath that from July 16-18, 2016, Duhar was at the 66th Military Hospital located in Pokrovsk, Donetsk Oblast.\u00a0<a href=\"https:\/\/www.radiosvoboda.org\/a\/news-duhar-sud-zapobizhnyi-zakhid\/30379149.html\" target=\"_blank\">[20]<\/a><\/p>\n<p style=\"text-align: justify;\">On January 10, 2020, Reporters without Borders also noted faults in the investigation and evidence, saying that \u201cthe claim to have solved the case is based on four disputed expert reports and the prosecutor\u2019s office is refusing to release all of the evidence in its possession. The leading suspect has lodged a complaint against the president and interior minister, there have been attempts to pressure and blackmail certain witnesses, and now a series of revelations in the past few days has cast further doubt on the investigation.\u201d<a href=\"https:\/\/rsf.org\/en\/news\/ukraine-must-be-less-cagey-about-sheremet-murder-case-rsf-says\" target=\"_blank\">[21]<\/a><\/p>\n<p style=\"text-align: justify;\">According to the defense, the entire process in this case features multiple procedural infractions. Police have limited access by the defense to important materials. Prosecutors may not appear for court hearings or they appear without bringing the defendants. On January 3, 2020, Orekhovsky &amp; Kolomiets, a law firm defending Yana Duhar, filed a 16-page Statement of Crime with the State Bureau of Investigations accusing law enforcement with charging a knowingly innocent person (Part 2 of Article 372 of the Criminal Code), deliberately falsifying expert opinions (part 1 of Article 384 of the Criminal Code) and deliberate unlawful detention and arrest (part 1 of Article 371 of the Criminal Code).<\/p>\n<p style=\"text-align: justify;\">The defense has consistently brought investigative and procedural violations to the attention of the judges at numerous court hearings. However, our Ukrainian Lady of Justice seems to turn a deaf ear to their appeals.
